What are legal steps to resolving an auto insurance claim?

Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. I shouldn't have to wait for 2 years only because the driver refuses their offer. I should get my share at least. Do I have a legal case against the company for taking too long in this regards ? What can I do to resolve this ?

Hypothetically lets say a couple months down the road I have a change of heart and am able to afford the repairs for my car. So now my car is up and running etc etc. Why is it that now when I sign up for insurance again my rates will be higher. My situation is that I have a vehicle but it is a lot older and it is broken down right now. It is going to be a few months before I can get it fixed. So, I thought of canceling my insurance bc I was wondering why should I pay insurance for something I am not driving. I, then, told my agent that once i got it fixed i would add the insurance back, he then told me what the consequences of my actions would be. Why do my rates go higher just bc I get rid of the insurance? It's not like I am doing anything illegal. I would not be driving the car bc it is broke down.

I had a accident on my motorcycle 09/09/11. I had full coverage insurance, now my insurance company tells me they are not responsible for anything, I have to contact the other parties insurance. My insurance company has not even gave me a claim number,hasn't paid any dr bills. Also it totaled my bike! Why pay for full coverage if they don't do anything for you?

Here's the deal. I got a letter from the Ohio BMV saying that I have been randomly chosen to prove I have insurance on one of my vehicles. I do have insurance, have always had insurance, (at least for the last 25 years or so) As I got to thinking about it, it started bugging me because it seems that this violates my 4th, and possibly my 5th, and potentially my 6th amendment rights. The letter kindly apologizes for any inconvenience, then states that if I do not comply, my license will be suspended. I begrudgingly intend to comply, just to avoid any hassle, but before I do (I have 3 weeks) I was hoping someone could explain to me how this can be legal. I can kind of understand having to prove compliance during a traffic stop, but randomly??? Through the mail??? The audacity of these people is troubling. Game on.

As a 38-yr-old female with a BMI that is(was) borderline obesity, I pay $278 per month (about twice the original quote on the website which was about $140.) I freelance. One of my jobs collects contributions from my employers into an account that I can use to reimburse my premium payments, and I was hoping that I'd be able to make enough to use that account to really pay toward my monthly health insurance.
