What are legal steps to resolving an auto insurance claim?

Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. I shouldn't have to wait for 2 years only because the driver refuses their offer. I should get my share at least. Do I have a legal case against the company for taking too long in this regards ? What can I do to resolve this ?

I recently had my car damaged in one of our Texas storms. It caused about $4000 in damage to the entire left side, hood, and both bumpers, and knocked out two windows. I just got my car back from the insurance suggested body shop and I can still see where many of the rock marks were painted over. There are divets in the paint in a lot of spots, which is better than the metal that was showing before, but not how I want it. My question is, shouldn't they have completely sanded down the areas of the car that needed to be repainted instead of just painting over the paint nicks? The car is a 2006 Mustang that is practically brand new. Maybe I am wrong, but shouldn't the insurance company be fixing the car to the PERFECT condition it was in before it was damaged?

So, I found out today, that State Farm canceled my car insurance. My coverage was good through Feb. 1st. My billing date is also Feb. 1st, but they usually charge me a day or two late. I just got quotes for a new Mazda 2. Full coverage on the Mazda 2 will increase my total premium by $163. Full coverage quote for a 2007 Focus would be $187 increase. Full coverage quote for a Hyundai Elantra would result in a $176 increase. I find this very surprising. I thought used cars were supposed to result in cheaper insurance coverage.

A few weeks ago my car was rear ended and has minor frame damage from the collision. The insurance adjustor's checked it out and offered me $700 to fix the paint on the bumper, repair the bumper support and 2 hours on a frame rack. Details about my car: The passenger rear taillight is pushed in about a centimeter - the quarter panel now sticks out a tad and is crumpled in the wheelwell - my passenger framerail has a warp in it from the accident. Now they are claiming that my car was in a previous accident because of filler paint or something in the trunk. They claim that because I have a hole cut into my frame rail that the car was previously pulled and that's where the damage came from. I drove the car for 4 years, I think I'd know if my taillight was pushed in and my quarter panel was sticking out. They told me to take it to an auto body to have it looked at and they would contact them on a final settlement - BUT I feel the car is unsafe to drive. I do not want to drive a car with previous frame damage (fixed). Would I be able to take the money and buy a different car without the body shop doing work on it?

A friend of mine has Blue Cross Blue Shield through his employer in Florida. His premium is a whopping $600.00 a month. FYI: this falls under New Mexico laws I drove a small 2 door honda civic and was on my way to school. There was alot of traffic being it was around lunch time and i was approaching an intersection when this dodge durango came out of nowhere and tried to cross in front of me. One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

My car insurance expired on 6/19 at 12am so that same day we went to our insurance broker and purchased a new full coverage policy at 2:30 pm. On 7/24 I was at a Dairy Queen drive thru the person behind me hit the truck I was driving. I was looking at her in the rear view mirror the entire time. She had a cigarette hanging from her mouth that was unlit and she eventually backed up after hitting me. I got out of the truck and looked and I did not see any damage. She then said I didn't move you hit me I then told her No I did not hit you I am in front of you and this truck was never in reverse. Since there was no damage to the truck I did not bother getting any of her information since it was not my fault. On 7/27 I got a call from the police saying she told them I hit her. I gave them my side of the story and they said she had a witness who was a passenger in her car and they will be in touch. I also let them know I had a witness as well. The cop called me back yesterday and wanted to get my insurance information so her and I could exchange information. My question is do I have to give my insurance information to this cop? I did not hit this woman and I think she is trying to get one over on the insurance company. The cop said yesterday I'm surprised the truck does not have any damage because her car does have damage. This truck was a rental truck which was inspected at the time it was dropped back off at the rental company obviously there was no damage to it. This woman looked like she was on something to begin with and I'm guessing she was not paying attention probably looking for a lighter and let off the break and hit me. Which I still don't see how her car would be so damaged. I don't want this con artist having my information. So should I tell the cop I am not giving him my insurance information and tell her to take it to court? Should I get a lawyer? I will be buying my first car soon and I have a few choices to pick from. I'll have to pay for everything myself (insurance, fuel, maintenance, etc.). While I am employed, I work at home for a company in another state, and the dental insurance options through my company were not viable. So, of course, I relied on the internet to research my options, and I looked, specifically, for dental insurance Lo and Behold, the stuff that came up, was for Dental Discount Plans. Upon first glance, it seemed like this could actually have been a better deal then anything offered through my firm. The conversation on the websites touted these plans, often with premiums of $7 to $20 per month, to be better than conventional dental insurance in every imaginable way. No issues in applying, no maximums, no deductibles, and no waiting. So, I am sitting here, reading how in EVERY possible way this is better than insurance, and it strikes me. If something seems to good to be true, maybe it is. If these were so much better than conventional insurance, why did my firm have so much trouble finding affordable insurance; they should have simply joined one of these discount programs. Well, the site even attached me to an independent article which BASHED the conventional insurance...Then it struck me...If I was a dentist, would I be happy joining these discount plans and basically getting 50% to 75% less for my services. Yeah Yeah, I am getting my payment up front and not waiting for the insurance to pay me (again, playing the role of the dentist), but is that worth the tremendously discounted amount (does not make sense when you compare the time value of money). So, I realized that if I were a dentist, I would not want anything to do with these plans...Or would I? Does being a part of these discount programs really bring in enough clients to justify that deep a cut in the fee schedule. Then I started to think...Is it possible that there is something up with these deeply discounted fee schedules I keep seeing on these sites? Are the fees just being jacked up and then discounted back down to the point where I might as well not be a member of the Discount Program, and just a regular walk in? Can I go to a dentist and ask them for the fee schedule, and then after the fact, compare it to the discount program to see that I am really getting a discount, and it is not some number playing farce. I would want to know as a dentist whether these discount programs are worth anything. I need some kind of coverage, and for the few self insurance programs I see, the monthly premiums are incredibly high, and yes, when compared to the discount programs, it seems like NO ONE would EVER join these insurance programs since they are more limited and more expensive...Yet....They are still in the insurance business. Audatex is not kelly blue book they look at craigslist & not the dealer. Craigslist sometimes has cars where a mechanic might not catch it but is damaged. I was just recently involved in an accident and the insurance company that is responsible to pay for the damages is saying that I need to move my car from storage, because they do not have to pay for the car to remain in storage. Since I live in an apartment complex the car would have to be moved twenty minutes away, which is going to cost quite a bit and then we would have to move it again to an auto body shop back to the area I live in. So I called the place where it was stored to get a quote on how much it would cost to move it and the guy said that our car looks to be totaled and that for them to tow it I would have to pay out of pocket and I will never see that money again. Also, he said, in Texas, it is state law for the insurance company to pay storage and towing fees, he said the insurance is just saying that to get us to move it so they don't have to pay those extra fees. Back in August, I got a quote on a car, it worked out as 900 for the year.(I'm only 17), and since then I've been getting regular quotes, and can't help but notice how much it's gone up. PLEASE READ THE WHOLE THING Okay so long story short, my bank messed up and my car insurance didn't get paid for.. This was about 3 or 4 months ago. And then it just stopped withdrawing money from my account each month, and I figured I would just take my chances and go without insurance. I didn't cancel it or anything. I had State Farm, and I figured because I was getting a new car anyway I wouldn't bother, but getting a new car took a lot longer than than I thought and I just ended up getting one yesterday. So I got a 2000 Buick Park Avenue, it has airbags, all that. It should have a decently low insurance rate. I have gotten 1 speeding ticket, but no accidents. When I called for a quote though, through a different car insurance company, they told me it would be $230 a month. Why is it so high? Is it because I stopped paying for my State Farm Insurance?

My car insurance company rang me two weeks ago asking to update my details. I was previously registered as a student and unemployed but changed this to working part time as an admin assistant. A week ago I received my new certificate of insurance but today they rang me to say that my premium had increased by 150! I find this difficult to understand how changing my profession from student to admin could whack up my premium by this much. At the same time they offered me a new deal from another insurer , which they claimed would be cheaper, but I refused over the telephone as I felt too confused at the time. Today I was in car wreck. I was in a parking lot going straight and the other driver turned left in to my car. She has dented the whole left side of my car. I called the police but because it was in a parking lot they could not do much. An officer showed up because she refused to give me her proof insurance. The officer said she was clearly at fault but could not cite her because of the private property thing. My question is does anyone know or have any idea how this will play out with her insurance? My car has a lot of damage and i'm in a lot of pain. I won't be able to go to the doctor/hospital until tomorrow because I won't have the money for a co-pay until then. The officer was very nice, he sided with me put all the blame on her, she claimed it was an accident when she clearly just didn't stop before making a left into my car, I thought she was going to stop and I tried to avoid her but she was going to fast. I filed a claim with USAA on September 5th on a hit and run accident in which the police were able to find the person and get his insurance. He called them and said he didn't do it - and I hit him. I called, gave my side of the story and the number of the police who were handling the accident. They always say they will call me back and they don't - so I call them in which they give me another date they will get back to me. They never ONCE have gotten back to me. The policy holder who hit me is now in jail on an unrelated offense and they say they cannot get his statements - duh. They say they will contact the police and get back to me - but they never have. The damage to the car isn't that much - it is $416 (just a headlight) but I cannot afford to pay for it. Putting it through my insurance is dumb because the deductable is $500 - at least I think that is how it works. Could you give me advice on how to deal with USAA? I can't talk to them on the weekends because they say they can't handle my existing claim. I'm getting REALLY frustrated.
